1) Acceptance of these Terms

By accessing our website or using any service (including creating an account, purchasing a plan, booking a session, or downloading content), you agree to these Terms and to our Privacy Policy and Refund/Cancellation Policy (together, the “Agreement”). If you do not agree, do not use the Site or Services.

2) Eligibility

You must be at least 18 or the age of majority in your jurisdiction.
If you access on behalf of another person, you represent that you are authorized to bind them to this Agreement.

3) Nature of services (kundli‑based & spiritual)

Our offerings are spiritual/astrology‑based guidance and creative/ritual content (e.g., yantras, mantras, sigils, readings, guidance).
We do not provide medical, legal, financial, or psychological advice. Our content is not a substitute for professional care. For any health, legal or financial concerns, consult a qualified professional.
Results, outcomes, “energetic effects,” or “siddhis” are not guaranteed and are inherently subjective. You agree to use discretion and personal judgment.

4) Accounts & security

You are responsible for your account, credentials, and activity. Notify us immediately of unauthorized use.
We may suspend or terminate accounts that violate this Agreement or applicable law.

5) Memberships (Pricing Plans) & Guardian Vault

Plans grant access to specified benefits for the stated term (e.g., Vault access, downloads, eligible services).
Plan details (term, price, renewal, benefits) are displayed at purchase. Some plans auto‑renew until you cancel.
Where configured, plans may include limited sessions for linked services. Session counts are tracked by the platform and visible at checkout and/or My Bookings.
Benefits are personal, non‑transferable, and may not be resold or shared.

Upgrades/downgrades/cancellations: Take effect per plan rules at the next billing cycle unless stated otherwise. See Refund/Cancellation Policy.

6) Bookings & sessions

Booking availability is not guaranteed and may vary by practitioner, timezone, or holidays.
Rescheduling/cancellation windows and any fees are stated at checkout or in the booking confirmation. Missed appointments may be charged.
If a booking is tied to plan sessions, rescheduling late or no‑show may consume a session.

No emergency services: Our services are not for emergencies or crisis situations.

7) Digital products & downloads

Unless expressly stated, downloads (yantras, guides, PDFs, artwork) are for personal, non‑commercial use by the purchasing member.
You may not redistribute, resell, or publicly post downloads without a separate written license.

8) Custom works (yantras, designs)

For custom works based on your inputs (including birth details), you represent that the information is accurate and that you have the rights to all content supplied.
Unless we grant a separate commercial license, we provide you a personal, non‑transferable license to use the deliverables for your own spiritual practice.
We may retain a copy for portfolio, quality assurance, or dispute resolution, excluding any personally identifying content you ask us to remove or anonymize (as permitted by law and our Privacy Policy).

9) Acceptable use

You agree not to:

Violate any law or third‑party rights (including IP, privacy, publicity).
Upload or request content that is illegal, hateful, or incites harm.
Attempt to interfere with the Site, security, or other users’ access.
Use the Services to provide medical/legal/financial advice to others.
Misrepresent outcomes as guaranteed or claim that we endorse uses we have not explicitly approved.

10) Payments & taxes

Prices are shown at checkout in the stated currency and are subject to applicable taxes.
Payments are processed by third‑party gateways (e.g., [Razorpay/Stripe/Wix Payments/PayPal]). We do not store full card/UPI data.
Chargebacks or payment disputes may result in suspended access until resolved.

11) Refunds, cancellations & renewals

Policies for refunds, cancellations, and renewals are set out in our Refund/Cancellation Policy (incorporated by reference).
If you purchase a plan with auto‑renewal, you can cancel any time before the next renewal date to avoid future charges. Amounts already charged may be non‑refundable unless required by law or our policy states otherwise.

12) Intellectual property

All Site content and deliverables we create (text, graphics, logos, designs, images, templates, code) are owned by us or our licensors and are protected by IP laws.
You receive a limited, personal license to access the Site and use purchased downloads pursuant to these Terms.
Except where a separate license is granted, you may not copy, modify, reproduce, distribute, or create derivative works from our IP.

User content: You grant us a non‑exclusive, worldwide, royalty‑free license to host and use the content you submit solely to provide the Services (e.g., to create your custom yantra), and to store a copy for legal, security, or quality assurance purposes.

13) Third‑party links & tools

We may link to or integrate third‑party services (e.g., video meeting tools). Your use of third‑party services is governed by their terms and privacy policies. We are not responsible for third‑party acts or omissions.

14) Disclaimers

Services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied.
To the fullest extent permitted by law, we disclaim merchantability, fitness for a particular purpose, and non‑infringement.
We do not warrant specific outcomes from spiritual, astrological, or energetic practices.

15) Limitation of liability

To the maximum extent permitted by law, we (and our directors, officers, employees, and agents) are not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenues, goodwill, data, or use, arising from or relating to the Services, even if advised of the possibility.

Our total liability for any claim will not exceed the amount you paid to us for the Service giving rise to the claim in the 3 months preceding the event (or INR [amount], whichever is lower), unless a higher cap is required by law.

16) Indemnity

You agree to indemnify and hold us harmless from claims, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your breach of this Agreement, violation of law, or infringement of third‑party rights.

17) Data protection & privacy

We handle personal data as described in our Privacy Policy. By using the Services, you consent to such processing and to international transfers as described therein.

18) Complaints & takedowns (IP/privacy)

If you believe your IP or privacy rights are infringed by Site content, contact shaktikaaldharma@gmail.com with details.
We will investigate and act in line with applicable law.

19) Suspension/termination

We may suspend or terminate your access for breach, suspected fraud/abuse, non‑payment, or to comply with law. On termination, licenses granted to you end, except those that survive by nature (e.g., IP ownership, liability limits, dispute resolution).

20) Force majeure

We are not responsible for delays or failures due to causes beyond our reasonable control (e.g., natural disasters, outages, war, acts of government, platform failures).

21) Governing law & dispute resolution

Governing law: The laws of [State], India, without regard to conflict‑of‑law principles.
Venue: Courts in [City, State], India shall have exclusive jurisdiction.
Optional arbitration: If you prefer, insert an arbitration clause here (e.g., institutional rules, seat, language) to reduce litigation risk.

22) Changes to these Terms

We may update these Terms from time to time. The new effective date will be posted. Material changes may be notified by email or Site notice. Continued use after changes means you accept the new Terms.

23) Miscellaneous

Entire Agreement: This Agreement supersedes prior terms on the same subject.
Severability: If any part is invalid, the rest remains in effect.
No waiver: Failure to enforce is not a waiver.
Assignment: You may not assign your rights without our consent; we may assign to an affiliate or in connection with a merger or asset transfer.
Notices: We may contact you at the email provided in your account.
